Independent commissioners green light Burger King–Starbucks consent

Independent commissioners have today confirmed their approval of the resource consent application from Tahua Properties Limited, to establish and operate a Burger King and Starbucks retail and drive through facility in Tīrau.

The application was publicly notified in June last year, with 148 submissions received, while a hearing held over two days in August 2025 received evidence and submissions from the applicant, Council and submitters.

Following deliberations, the commissioners have granted consent, subject to conditions which include the restriction of operating hours to between 5am-11pm.

Several other conditions have been imposed - both for during the construction period and operational period - which must be met. This includes consideration of school hours during construction, restrictions on lighting and signage, landscaping and waste management.

“This process has been overseen by two independent and well qualified commissioners, which was only appropriate given the complex planning issues associated with it,” said Gary Knighton, South Waikato District Council Planning and Performance Manager.

“This topic has been of significant public interest and attracted a range of passionate viewpoints.”

There is now a 15 working day period in which appeals can be lodged with the Environment Court.
